\u00a0<\/strong>Absolument. L’article 11 (a) de la loi sur les indemnit\u00e9s de licenciement<\/a> de 1963, stipule express\u00e9ment que \u00ab\u00a0si un employ\u00e9 d\u00e9missionne en raison d’une d\u00e9t\u00e9rioration tangible des conditions de travail ou en raison d’autres circonstances intervenant dans la relation \u00e0 l’\u00e9gard de ce m\u00eame employ\u00e9 \u00e0 qui on ne peut demander de rester \u00e0 son poste, la d\u00e9mission est consid\u00e9r\u00e9e comme un licenciement\u00a0\u00bb.<\/p>\n

En d’autres termes, la d\u00e9mission d’un employ\u00e9 en raison d’une d\u00e9t\u00e9rioration tangible des conditions de travail, est consid\u00e9r\u00e9e par la loi comme un licenciement \u00e0 tous \u00e9gards. Il va sans dire que cela affecte le droit aux indemnit\u00e9s de d\u00e9part. Ceci est \u00e9galement vrai lorsque le contrat de travail sign\u00e9 par l\u2019employ\u00e9 tente d\u2019en d\u00e9terminer autrement. Comme chacun le sait, tout contrat peut contenir des dispositions qui peuvent contourner la loi.<\/p>\n

Qu’entend-on par \u00ab\u00a0d\u00e9t\u00e9rioration tangible des conditions?<\/h4>\n

Tout changement n\u00e9gatif dans l\u2019environnement professionnel n\u2019est pas n\u00e9cessairement consid\u00e9r\u00e9 comme une d\u00e9t\u00e9rioration tangible. Le droit du travail n\u2019a pas d\u00e9fini avec exactitude \u00e0 quel moment il y a \u00ab\u00a0d\u00e9t\u00e9rioration des conditions de travail\u00a0\u00bb, n\u00e9anmoins, de nombreuses d\u00e9cisions des tribunaux du travail ont \u00e9tabli, au fil des ann\u00e9es, des crit\u00e8res concrets qui permettent d\u2019\u00e9tablir la d\u00e9t\u00e9rioration tangible de ces conditions.
